These terms govern your use of Simplexicity. They're written to be readable; if anything is unclear, email us before you sign up.

1. Eligibility

You must be at least 13 years old to use Simplexicity. You must not be barred from using AI services under the laws of your country. By creating an account, you represent that you meet both conditions.

2. Account security

You're responsible for keeping your login credentials secure and for everything that happens under your account. If you suspect unauthorized access, change your password and email us immediately.

We reserve the right to suspend or terminate accounts that violate these rules. We aim to give notice and a chance to correct course; abuse cases involving illegal content get acted on immediately.

We aim for high availability but don't guarantee uninterrupted service. Maintenance windows, third-party provider outages, and rare bugs do happen. For active production use cases, monitor /status.

7. Disclaimers

Simplexicity is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow these disclaimers; the limitations apply only to the extent legally permissible.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you in any 12-month period is capped at the greater of (a) the amount you paid us in that period or (b) $100 USD. We're not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data, or goodwill.

9. Termination

You can terminate at any time by deleting your account. We can terminate for material breach of these terms (acceptable use, payment) with reasonable notice, except in cases of illegal content or active abuse. On termination, you lose product access; we delete your data per the schedule in the Privacy Policy.

10. Governing law & disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Disputes go to binding arbitration in San Francisco County, with the AAA's Consumer Arbitration Rules. Either party may bring a claim in small claims court for amounts within the court's jurisdiction. You waive participation in class actions to the extent permitted by law.

11. Changes

If we update these terms, we'll bump the "Last updated" date above and email account holders if the change is material. Continued use after a material change means you accept the updated terms.
